Environmental Impact Assessment in the Riviera Maya: SEMA Guide

The environmental file is the longest item on the critical path of most projects in this corridor, and the one most often started too late. It is also widely misunderstood: owners expect a form, and what is actually required is a technical study of a specific piece of land, prepared by specialists, reviewed by an authority with discretion, and resolved with conditions that bind the project for its operating life.
This explains when an assessment is needed, who reviews it, what the studies contain, what it costs and how long it takes, and — the part people skip — what the conditions in the resolution require of you after the building is finished.
Who Reviews What
Jurisdiction depends on the type, location and scale of the project, and getting it wrong wastes months. In broad terms:
- State level (SEMA Quintana Roo) handles most private residential and many commercial projects that are not in federal jurisdiction — a house on a vegetated lot, a small development, a local commercial building.
- Federal level (SEMARNAT) takes projects in federal jurisdiction: those affecting mangrove, dune and other federally regulated vegetation, works in the federal maritime-terrestrial zone, projects inside or affecting protected natural areas, tourism developments above certain scales, and activities on the federal list.
- CONAGUA for water-related authorisations: use of national waters, works affecting the aquifer, and discharge.
- Municipality layers its own requirements and will not issue the construction licence without the environmental resolution where one is required.
- Protected areas — the Puerto Morelos reef park, Yum Balam, Sian Ka'an, Isla Contoy and others — bring their own management programmes, and within them what is permissible is defined by zoning inside the area, not by the surrounding municipality's rules.
The first professional task on any vegetated or coastal lot is therefore to determine jurisdiction and instrument. That takes a specialist consultant a short time and it sets the whole programme.
What the Study Actually Contains
The instruments range from a simple preventive report to a full impact statement, and the content scales with them. A typical MIA for a project here includes:
- Vegetation inventory, species by species on the affected area, identifying protected species and the volume to be removed. This is the document that usually determines how much of the lot you can actually use.
- Fauna survey, with attention to protected species — and on the coast, to turtle nesting.
- Hydrogeology: the karst, cenotes and caves, groundwater depth and flow direction, and how the project's discharge will interact with the aquifer. In this region this is the technical heart of the document.
- Project description with the footprint, the phases, the water balance, the wastewater solution and the waste management plan.
- Impact identification and mitigation measures, which is what the authority negotiates — retention of vegetation, relocation of species, setbacks, treatment standards, construction-phase controls.
- Restoration and compensation commitments — replanting, dune restoration, or contributions where applicable.
- Monitoring programme for construction and operation.
The consultant preparing it must be qualified and registered appropriately, and the quality of the document has a direct effect on the outcome. Thin submissions come back with requests for information, and each round costs weeks.

Those durations assume a complete, competent submission. They extend with each request for additional information, and they cannot be compressed by pressure — which is why the file starts before the architecture is finished, not after.
The conditions are the part people forget. A favourable resolution is not a permission slip; it is a contract with obligations that run through construction and into operation:
- Retention and replanting commitments, often with a survival requirement and reporting.
- Treatment plant performance standards and a maintenance and monitoring regime with records.
- Construction-phase controls: sediment control, waste management, noise and working-hour limits, and a designated environmental supervisor on larger projects.
- Operating restrictions: lighting specifications where turtle nesting applies, limits on beach or shoreline activity, water consumption reporting on larger projects.
- Periodic reporting to the authority for the life of the project, and inspection powers.
Non-compliance carries fines, suspension and, in serious cases, closure — and enforcement in Quintana Roo has become noticeably more active. Two practical consequences. First, build the conditions into the operating budget and into the property manager's responsibilities, not into a folder. Second, when buying land or a built property, ask for the environmental resolution and its conditions, and check compliance history: inheriting a clean, compliant file is worth real money, and inheriting a non-compliant one is a liability that transfers with the asset.
