Permits and Building Rules in Akumal

Akumal belongs to the municipality of Tulum: land use and the licence with a DRO are processed there, and most lots require SEMA environmental authorisation. Beachfront brings a ZOFEMAT concession, and being a turtle nesting area there are conditions on sea-facing lighting and night work between May and October. A hotel adds hotel-use zoning, the operating licence, Civil Protection, CFE capacity and tourism registration; drainage is solved with a plant or biodigester, never a septic pit.

The lot: what decides your foundation

Fractured limestone with caverns and cenotes, a shallow water table and heavy salt exposure facing the reef. A geophysical survey up front avoids the worst overrun in the area, and the structure is designed with marine-grade cover and admixtures. Drainage must be solved with a biodigester or a compact treatment plant — discharging badly in Akumal is a serious legal and environmental risk because of the reef.

Akumal is beach, reef and sea turtles: beachfront villas and small hotels of 8 to 15 keys, with demand that pays to be on the bay rather than to have a hundred rooms. The flip side is the rulebook: Tulum municipality, SEMA on most lots, ZOFEMAT on the beachfront and restrictions on lighting and night work during nesting season. What works in this area

Akumal lives off the reef and diving, with occupancy spread more evenly across the year than Tulum. What works is the small eight- to twenty-key hotel with direct bay access, or the three- to four-bedroom villa for diving groups. The turtle-season restriction is not a detail: it governs exterior lighting and night-time activity for half the year.

The ground and the authority that applies

The water table is high, particularly towards the front of the plot. Foundations are resolved shallow and widened, cisterns are anchored against uplift, and pool excavation usually needs dewatering.

The competent municipality is Tulum, and the environmental file falls to SEMA + SEMARNAT (ZOFEMAT, duna, tortuga).

Being beachfront brings ZOFEMAT into play: the federal twenty metres from the tide line are not bought but concessioned, and the concession does not pass to a buyer on its own. Before designing, measure the usable depth of the lot after deducting that strip and the municipal setback line.

Turtle nesting season, May to November, governs lighting on the seaward side — warm, shielded and directed downward — and in some cases limits night-time works.

The standard here is 50 mm of concrete cover over the steel and f'c 250 or higher with a chloride-inhibiting admixture; 316 stainless — not 304 — for balustrades, hardware and anchors; marine-finish aluminium with stainless fixings; condensers on the landward side with coated fins. The premium over an inland lot is 12 to 20 percent, and without it the first refurbishment arrives around year six.

The estate's internal rules apply alongside the municipal licence: heights, setbacks, facade materials, working hours and a bond. Ask for them in writing before the concept design, because the criteria get updated and are usually more restrictive than the municipal norm.
