Permits and Building Rules in Petempich Bay

Petempich Bay belongs to the municipality of Puerto Morelos, independent since 2016, and sits within the influence area of the Puerto Morelos Reef National Park. Land use and the building licence with a DRO are processed there; beachfront lots require a ZOFEMAT concession and, in practice, always an environmental authorisation, with conditions on clearing, runoff, beach-facing lighting and wastewater treatment. This is one of the areas where the environmental file sets the entire construction calendar. Lodging adds another layer: a land-use certificate with hotel designation — not every lot allows it, and it is the first thing we verify — the operating licence, Civil Protection sign-off, a CFE electrical project sized to occupancy and tourism registration. A restaurant open to the public adds health and capacity requirements.

The lot: what decides your foundation

Coastal limestone with a very shallow water table facing the reef. The soil study sets the foundation and the finished floor level, and the structure is designed with marine-grade cover and admixtures. Drainage is solved with a treatment plant or biodigester — never a simple septic pit — because any badly resolved discharge reaches the reef.

Petempich Bay is discreet beachfront with few lots, inside the influence area of the Reef National Park. A high-ticket villa is the clear product; for lodging, small formats where land use allows them, with mandatory wastewater treatment and a carefully handled environmental file from the start.

Bahía Petempich is resort territory rather than independent short-let: the sheltered bay and calm water sustain large all-inclusive hotels. For a private project that means two things — competing for staff with those hotels, and a buildable strip that mangrove and ZOFEMAT cut back far more than the deed suggests.

The ground and the authority that applies

The water table is very high: on most lots water appears in the first metre of excavation. That rules out a basement, forces a flotation check on cisterns and tanks, and makes dewatering during the pour a real budget line rather than a surprise.

The competent municipality is Puerto Morelos, and the environmental file falls to SEMARNAT + ZOFEMAT.

Being beachfront brings ZOFEMAT into play: the federal twenty metres from the tide line are not bought but concessioned, and the concession does not pass to a buyer on its own. Before designing, measure the usable depth of the lot after deducting that strip and the municipal setback line.

What decides this particular plot: frente de playa con manglar detrás: la franja construible suele ser mucho menor que el lote.

Site logistics and specification

Access: acceso único desde la federal.

Severe salt exposure. The standard here is 50 mm of concrete cover over the steel and f'c 250 or higher with a chloride-inhibiting admixture; 316 stainless — not 304 — for balustrades, hardware and anchors; marine-finish aluminium with stainless fixings; condensers on the landward side with coated fins. The premium over an inland lot is 12 to 20 percent, and without it the first refurbishment arrives around year six.

There is no design committee: the municipal licence is essentially the whole procedure, which shortens the calendar and makes this kind of lot a good candidate for a fixed-price contract, with fewer unknowns underground.

First, the lot’s land use has to allow hotel operation: without it there is no project, which is why we verify it before you buy. Then come the operating licence, Civil Protection, CFE capacity by occupancy, properly sized wastewater treatment and tourism registration. We handle them alongside the build.
