Permits and Building Rules in Aqua, Cancún

In Benito Juárez the building licence goes through the Urban Development office with a DRO-endorsed project. Puerto Cancún and the Hotel Zone add FONATUR sign-off and, on beachfront lots, a ZOFEMAT concession. Gated communities such as Cumbres, Aqua and Lagos also run a design committee with height, façade and working-hours rules.

The lot: what decides your foundation

Limestone with fill areas and a high water table near the Nichupté lagoon. The soil study sets the foundation type and the damp-proofing strategy; on lots near the lagoon, reinforced waterproofing and anti-corrosion protection of the rebar are mandatory.

Aqua is among Cancún’s highest-prestige residential estates by value per m², on Huayacán and close to the lagoon system. Beachfront inside the Hotel Zone

Aqua is beachfront development inside the hotel strip, and it stacks the three most demanding regulatory layers in Cancún at once: Benito Juárez municipal rules, the FONATUR planning legacy, and federal ZOFEMAT over the first 20 metres from the tide line.

Before designing we check three things, in this order:

  1. The real usable depth of the lot after deducting ZOFEMAT and the setback line, which can cut the buildable footprint substantially.
  2. The status of any ZOFEMAT concession: it does not transfer to a buyer on its own, and renewal runs on its own calendar.
  3. Dune and coastal vegetation, federally protected. Removing them without procedure is a criminal matter, not a fine.

And one operational restriction that catches owners out: turtle nesting season, May to November, governs lighting on the seaward side — warm, shielded and downward-facing — and in some cases limits night-time works.

Building to last in the first row

Hard against the sea, a house ages in five years what it would age in twenty inland. The measures we apply as standard:

  • 50 mm of concrete cover over the steel, and f'c 250 or higher with a chloride-inhibiting admixture.
  • 316 stainless on every exposed metal element: balustrades, hardware, anchors, showers. 304 does not survive the first row.
  • Marine-finish aluminium profiles with stainless fixings; never a steel screw in an aluminium frame.
  • Condensers on the landward side, with coated fins and drains protected from sand.
  • Ground floor raised 80 to 120 cm above grade, against storm surge and run-off.
  • Impact glazing or hurricane shutters on every seaward opening.

The build premium over an inland house is 12 to 20 percent. Without it, the first serious refurbishment arrives around year six.
